A judicial hearing was convened to decide on the publicity of the complaint that led to something totally unprecedented, such as the raid on Donald Trump’s private residence, unknown terrain since it had never occurred with a former president, and given the polarization that the USA is experiencing could have long-lasting and unexpected consequences, if, as expected, the Republicans win the next mid-term elections in November.
The repercussions would be even greater if they were to strengthen, not weaken, Trump’s presidential candidacy, which is not official only because he is surely awaiting the evolution of his judicial situation, which also includes several other investigations, in the House of Representatives, and in several states such as New York and Georgia, and for the same reason, it is striking that this registry has not been made with the highest possible levels of transparency and care.
I mention the above because many or some of the doubts or criticisms towards the FBI or the Department of Justice (DOJ) would simply either not exist or would not occur in the same way, since for the United States it sounds strange that the cameras of the house as well as that the presence of their lawyers who remained outside had not been allowed, or in a world that demands transparency, images of the raid had not been transmitted, perhaps some live, as has been done in situations of minor transcendence.
The foregoing indicates that decisions of this type were surely taken at the highest level, which makes it difficult to understand why it had been done in this way, since, in a polarized country, immediate criticism arose of the politicization of justice and of the police, which may be unfair, but since what is happening in the Republican base was expected, it is incomprehensible that they had not ensured that he would be free of suspicion. In fact, at the hearing the judge himself asked the DOJ to propose a wording that would narrow the search, without affecting the investigation.
This way of acting may also have consequences for the division of the USA in the medium term, since as it is an issue where the police will inevitably become constitutional, mixing with the limits and scope of presidential prerogatives, with what It will reach the Supreme Court, setting precedents regarding what a president can or cannot do with the documents received, and there today the positions that Trump represents seem to have a majority for a decision in his favor.
Although there are other investigations, as Trump was perhaps the most scrutinized president in the history of the country, the issue behind this raid originated in a dispute with the National Archives, which were commissioned by a federal law to take charge of the documents of Historical importance. This is how this plot began and, as in other cases of former presidents, there were exchanges of opinions, and it is unknown at what point these were broken.
It would have been an affidavit that was behind the raid, and at the request of Trump’s lawyers that everything be made public, the ignorance or publicity of its content and the complainant, was what was behind what was asked resolve the judge.
As in many situations, the backdrop is a cultural war or guerrilla war between the two halves of the USA, with conflicting visions of the past, present and future, a battle of narratives, where even the media have taken sides, without even there is agreement on the facts, and where that Trump supporter half postulates the suspicion of politicization, arguing that the only objective would be to prevent Trump from running for the presidential elections next year, a Trump who has also resolved in his favor the disputes by interior of the Republican primaries, where the greatest triumph was that 8 of the 10 representatives (deputies) who voted in favor of his impeachment have been left out of Congress, including Liz Cheney, his most visible opponent within the Republicans.
According to this vision, this raid is a true “fishing expedition” that refers to something that is done just in case something is found. Thus, the issue of documents would have been used as a pretext to apply severe legislation, since, being based on a federal law, it allows a registry, where everything that is found (especially if it is true the transcendence that the complaint would refer to a specific place), it can be used against Trump.
It is added that the use of the Espionage Law against a former president would be a continuation of the so-called “Russian plot”, present in the United States since the 2016 election, according to which Trump would have been elected by manipulation of Putin, and for which not enough evidence has been found to support it. His lawyers have added that the use of this law and the transcendence of the penalties to which he would be entitled do not make sense, since the former presidents, all of them, including Trump, maintain complete A level in matters of access to security issues, being able to find out what they want, and until the day they die.
Finally, passion arises when comparing a supposedly different treatment of Trump in relation to the impunity that would have accompanied Hillary Clinton in the episode of the emails to which she had access when she was Secretary of State, and above all, in the most recent Hunter Biden, the president’s son, and what would be in a computer in the hands of the FBI, where there would supposedly be evidence of irregular actions that would involve his father, who by the way has always denied it.
It is possible that this is all false information, but the fact that most of the traditional media refused to publish it in the 2020 election and that it has been censored by big technology companies, has only increased conspiracy theories on the networks. social, with the argument that everything happened to prevent Trump’s victory and favor Biden’s candidacy.
True or false, the reality is that the silence of the traditional media was real, and that beyond an editorial decision, suspicions have reappeared, and with renewed force they present Trump as a kind of martyr.
Now, given the level of polarization in the US, what happens if the Republicans win the November elections? There are multiple elections, not only local mayors, prosecutors, judges or sheriffs, but also political governors; the totality of the 435 representatives is renewed like every two years, and partially of the 100 senators, who, by lasting six, renew a third.
Particularly important is that of the House of Representatives, since if the Republicans win, in a party that today is solidly pro-Trump, Nancy Pelosi would be replaced, and the new leader would not only be the third in the constitutional hierarchy, but could also be the end of the commission investigating the events of January 6, they would control the resources for the entire government, including the budget contribution to the White House, and new commissions would be created, probably on Biden’s son and the violence that took place during months in Democratic-controlled cities like Seattle or Portland, before the 2020 election.
Now, what would happen if Trump wins the White House? There would not only be a much more empowered president to fight his rivals, and therefore, more gasoline for the fire, but it could also be the announcement of assorted investigations including the FBI, and the mother of all battles, Big Tech, and the billionaire activists of those companies, also because North American politicians are the only ones who can do it, not only because they are the headquarters of the headquarters and the physical location of their supercomputers, but also because a legal statute from the 90s depends on them like the very important Section 230, which gives them a special status.
There are signs that a perfect storm has been created, where, over and above judicial intentions, the narrative that the reason is political to prevent Trump from participating in the next elections could be consolidated. Not only that, but it seems that he receives help from some Democrats, who, unintentionally, have contributed to keeping him in force, since almost everything always comes back to his administration.
The courts have accompanied Trump all his business life, and now, his political management is added, where he accepted silence as a right of the fifth amendment, and as a protest of what his supporters describe as a violation of the fourth, that is, which protects against unjustified searches.
And even if there is a basis for the raid, as long as all the background information that allows an opinion is not revealed, I will limit myself to asking three questions in conclusion: Is it possible that not only because of Trump, but also as a consequence of the fight against him, the United States has lost part of its essence?
Is it possible that, as a consequence of polarization, the United States has lost part of its exceptional character and the same thing is happening to it as to so many other countries?
Is it possible that the division has managed to put the United States on the path to its Latin Americanization?
